CONSTRUCTION LAW

Our Focus

Our founder, Bob Schuett, had over 30 years of experience in various roles in the construction industry from contractor to consultant to legal advocate. He was a former Chairman of the Canadian Construction Association and honourary lifetime member.

Co- founder, Don Goodfellow, has been practicing in the area of construction law for over 30 years, he has consistently been selected as a leading legal expert in the area of construction law and, most notably, he represented the winning party in the landmark decision of MJB Enterprises before the Supreme Court of Canada.

The other lawyers in our firm are active in educating both the construction industry and our peers in the legal community. For example, Russell Patterson is a Sessional Instructor in the Faculty of Continuing Education at the University of Calgary. Since 2016, he has assisted and eventually replaced our founder Bob Schuett in delivering, every Fall, a course in Construction Contract Law and Documents. Local members of the construction industry including architects, engineers, contract administrators, and owner/operators attend this course.

Adrianna Worman has previously taught a seminar on Builder’s Liens for the Legal Education Society of Alberta and, with Robert M. Schuett, has regularly provided seminars on the basics of Construction Contract Law to construction industry leaders and members of the Calgary Construction Association.

Although we strongly believe in the use of industry standard contract forms, including those available from the Canadian Construction Association, we strive to provide each of our clients with solutions that suit their unique needs.

Our clients include owners, contractors, and subcontractors representing projects of all sizes and every stage of the contractual relationship. It is our theory that a good negotiation can resolve disputes quicker and more cost efficiently than costly litigation while helping to preserve business relations between parties.

However, when necessary, we have the skills to represent our clients at arbitrations and litigation processes at every level of court in Canada.

The services we provide include:

  • Arbitration of construction disputes

  • Negotiation and settlement of construction disputes

  • Builder's lien matters for both owners and contractors

  • Litigation of construction disputes

  • Workmanship disputes

  • Progress payment and collection issues

  • Contract drafting and review

  • Contractual disputes

  • Incorporation and corporate restructuring of construction companies

  • Corporate succession issues

  • Tendering issues

We acknowledge that what we call Alberta is the traditional and ancestral territory of many peoples, presently subject to Treaties 6, 7, and 8. Namely: the Blackfoot Confederacy – Kainai, Piikani, and Siksika – the Cree, Dene, Saulteaux, Nakota Sioux, Stoney Nakoda, and the Tsuu T’ina Nation and the Métis People of Alberta. This includes the Métis Settlements and the Six Regions of the Métis Nation of Alberta within the historical Northwest Metis Homeland. We acknowledge the many First Nations, Métis and Inuit who have lived in and cared for these lands for generations. We are grateful for the traditional Knowledge Keepers and Elders who are still with us today and those who have gone before us. We make this acknowledgement as an act of reconciliation and gratitude to those whose territory we reside on or are visiting.
